10. Text Messaging Terms

17. Dispute Resolution and Arbitration

Arbitration shall take place in Williamson County, Tennessee, or by remote means if mutually agreed.

CLASS ACTION WAIVER: YOU AND THE TALLEY INSURANCE GROUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Nothing in this section shall limit either party’s right to seek injunctive or other equitable relief in a court of competent jurisdiction. Professional liability claims governed by our Errors & Omissions insurance are not subject to this arbitration clause.

18. Indemnification

You agree to indemnify The Talley Insurance Group from claims arising from your use of the Site.

19. Force Majeure

We are not liable for delays caused by events beyond our control.

20. Changes to Terms

21. Severability

Invalid provisions do not affect the rest of the Terms.
